This policy for Kytor Industries (“we,” “us,” or “our“), describes our various store policies, including shipping, refunds, exchanges and warranties. This applies to all physical products, services and digital goods (“product” or “products“). Including:

  • Purchase of a product
  • Product use
  • Lost, damaged or stolen products
  • A product defect or failure

FULLFILLMENT AND SHIPPING

Current stock levels and lead-times will generally be noted on the product page. Be sure to read the full title and description prior to order.

  • In-stock finished products are generally dispatched within 2 business days after receipt of payment.
  • Built-to-order and configurable products may not be started or finished until after receipt of payment. Lead-times will vary by product, but typically do not exceed 4-weeks. Contact us for the current lead time of the product you are interested in.
  • Engineered-to-order (“custom fabrication”) products must be designed and approved prior to the start of fabrication. This process may result in significant lead-times. Contact us for more information.

Physical products are shipped via courier including USPS, FedEx or UPS. We reserve the right to choose or modify the selected shipping courier without notice. Contact us in advance to preselect a specific courier, additional charges may apply.

A signature delivery may be required for some purchases over $200 at our discretion. Smaller orders may be configured with optional signature delivery available upon request for an added charge, contact us directly for a custom invoice in these instances.

Shipping fees include handling and packing fees as well as postage costs.

Carefully verify your address prior to order completion. Under no circumstances are we responsible for lost packages sent to an incorrectly filled address.

Shipping promotions such as discounted or free shipping offers apply only to the contiguous United States of America; lower 48 states.

Once an item has shipped, we have no influence on logistics and are no longer in control over the processing, handling or delivery tracking information or timing. Please refer to the courier for status updates.

FEES, TARIFFS, DUTIES AND TAXES

We collect Onondaga County and New York state sales tax on applicable purchases.

You are responsible for all additional fees and taxes including broker fees, tariffs, VAT, and import duties. If a package is returned due to non-payment of additional fees or taxes, a refund will be issued minus a 20% restocking fee and the cost of shipping, handling and packing. Kytor Industries performs due diligence to accurately classify Harmonized System (HS) Codes and monetary value on customs forms, no exceptions.

LOST OR DAMAGED ITEMS

In the unfortunate event a package is damaged:

  • Save all packaging. This includes the cardboard protective materials such as bubble wrap, and label. This will typically be required to process a claim.
  • Contact us, providing pictures of the damage. We will require at minimum your order number and clear, well-lit, high resolution (minimum 2 megapixel) photos to process an insurance claim (where applicable).
  • After the successful completion of an insurance claim, either a partial or full refund or replacement item will be provided at our discretion.

In the unlikely event a package is lost:

  • Contact us. Please include necessary information including your order number. We will file an insurance claim (where applicable).
  • After the successful completion of an insurance claim, either a partial or full refund or replacement item will be provided at our discretion.

RETURNS AND EXCHANGES

Due to the unique nature of built-to order custom fabricated products, services, and digital goods, we do not accept returns or exchanges.

Extenuating circumstances may apply. To become eligible for a return or exchange in an extenuating circumstance, it must be pre-approved in writing by Kytor Industries and your item must be unused and in the same condition that you received it. It must also be in the original packaging. Clearly mark your package with the provided RMA number, and mail to the following address using only United States Postal Service (“USPS”). UPS, FedEx, and DHL returns will not be accepted.

When approved for a return or exchange under an extenuating circumstance, you are responsible for return shipping charges. The following shall apply:

  • Once your return is received allow up to 2 weeks for inspection. We will also notify you of the approval or rejection of your return or exchange.
  • If you are approved, then your return or exchange will be processed.
  • Refund credit will automatically be applied to your original method of payment within 2 weeks.
  • The maximum refund is the original purchase price of the item, minus any applicable shipping charges.
  • Outbound shipping charges on the original sale are non-refundable and will be deducted from your refund.

We reserve the right to reject or offer a partial refund in the event of any of the following:

  • Obvious signs of use, weather damage, abuse or neglect.
  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
  • Any item that is returned more than 30 days after delivery.

Late or missing refunds:

  • We cannot control the speed at which your payment provider will process the refund.
  • Please contact your bank or credit card company, it may take some time before your refund is posted.

WARRANTIES, COMPLIANCE AND GUARANTEES

All products are provided as-is without any guarantees or warranties of any kind, either expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purchase, operational failure, damage, or loss of property. In no event or under any circumstances shall Kytor Industries be liable for any consequential, incidental, special, punitive or other indirect damages arising in any way including, but not limited to, loss of profits or business, even if Kytor Industries has been advised of the possibility of such damages. In no event or under any circumstances shall Kytor Industries be liable for any personal injury from installation, modification or use of products. Under no circumstances shall Kytor Industries’ liability exceed the amount paid to Kytor Industries for the original purchase.

Products are qualified through quality assurance procedures. Kytor Industries does not participate in National Recognized Testing Lab (“NRTL”) services such as UL, ETL, CSA or CE, and therefore products will not be listed and labeled. Products do not have approvals or compliance with certifying organizations such as DOT, NHTSA, USCG, or FCC. All motor vehicle products are for off-road use only.

Installation, modification and use of the products are done at the user’s own risk. It is the user’s responsibility to consult with their Authority Having Jurisdiction (“AHJ”) to ensure the products, services and digital goods provided by Kytor Industries may be used in their area. It is the user’s responsibility to gain approvals from the local AHJ including listing or permitting.

REVISIONS

The policy above may be revised at any time without notice and may be applied retroactively at our discretion.
